SC Refuses to Legalise Gay Marriage, But Asks States to Uphold LBTQIA Rights
The Supreme Court of India, during the pronouncement of its verdict in the same-sex marriage legality case, is delivering four judgments. This signifies a pivotal moment in the ongoing discourse surrounding the recognition of same-sex relationships within the Indian legal framework.
During the course of the hearings, the honorable court had suggested that the involved petitioners should contemplate the notion of collaborating with the government in establishing a specialized committee. The purpose of this committee would be to deliberate and construct a mutually acceptable solution or a middle ground concerning the matter at hand.
In response to the court’s suggestion, the Union government has demonstrated a willingness to establish a committee, which is set to be headed by the Cabinet Secretary. The primary objective of this committee would be to thoroughly examine and evaluate the administrative measures that could potentially be implemented to address various concerns pertaining to the provision of basic social benefits for same-sex couples.
By proposing the formation of this committee and actively engaging with the petitioners, the government is emphasizing its commitment to ensuring that the rights and well-being of same-sex couples are duly acknowledged and safeguarded within the framework of the law. This proactive step indicates a willingness to explore practical solutions and foster constructive dialogue, ultimately striving towards a more inclusive and equitable society for all individuals, irrespective of their sexual orientation or gender identity.
