Saint-Gobain Faces Allegations of Anti-Competitive Practices in India

The case, filed with the Competition Commission of India (CCI) in May by a retired glass industry executive, alleges that Saint-Gobain abused its market position in India's clear float glass and coated glass segments.

French multinational company Compagnie de Saint-Gobain is under scrutiny by India’s antitrust watchdog following allegations of anti-competitive behaviour.

Documents reveal that Saint-Gobain is accused of pressuring some partners to purchase glass exclusively from the company or risk being cut off from supplies altogether. The case, filed with the Competition Commission of India (CCI) in May by a retired glass industry executive, alleges that Saint-Gobain abused its market position in India’s clear float glass and coated glass segments.

Allegations Against Saint-Gobain

Saint-Gobain holds a significant market share in India, with a 44% share of the float glass market and a 19% share of the coated glass market. The allegations state that the company entered into arrangements with glass processors, coercing them to buy glass from Saint-Gobain or face supply disruptions exclusively. The complaint further claims that Saint-Gobain engaged in price-fixing with large customers, such as Indian real estate giant DLF, and then compelled distributors to supply at those rates, thus, creating unfair anti-competitive conditions.

Saint-Gobain’s Response and Previous Case

Saint-Gobain, in its response, remarked that it was unaware of any complaint, notice, or document served to the company and the group and its India unit, Saint-Gobain India Private Limited, assert that they conduct their activities in compliance with India’s competition laws.

However, This is not the first time Saint-Gobain has faced such accusations in India. In 2011, too, the company came under the scanner of an antitrust case; the same was, however, was dismissed by the CCI after conducting a two-year investigation, stating that Saint-Gobain was not abusing its market position or engaging in exclusionary practices.

Review Process by the Competition Commission of India

Although the CCI has not commented on the specific case, as is the policy, the details of cases filed or under review are not disclosed. At the moment, the CCI is in the preliminary stages of reviewing the allegations, and it has the authority to dismiss the case if it finds that there is no merit to the claim; it will obviously seek input from the company or may order a full investigation by its investigations unit, as the complainant has requested. Typically, the CCI takes up to three months to reach its verdict on a matter.
