MCA Website- Why The Government Is Giving Contracts To Them If They Are Not Competent To Give Efficient Outputs?
As a consequence of a technical problem on the MCA website, firms are receiving challans with additional fees.
Several complaints have been made since the inception of the MCA Portal about the problems caused by technological faults in the MCA 21, V2, and V3 Portals.
Some of the problems in the MCA website are listed below.
A user was not able to file linked form 3 and form 4 LLP. He raised lots of ticket raise and emails but hasn’t received any information within the stipulated time.
Another user wrote that their LLP incorporation is pending; which has not been solved in the time of 2 months.
Another issue of LLP was witnessed where the user has LLP pending from 2021. He couldn’t file on the old portal due to some reasons, and can’t file on the new portal either due to mca inefficiency. Many tickets have been raised by him, but all efforts are wasted as there was no effort done to resolve the issue.
Another person in trouble wrote that while he was filling out the form, in CRC, names are rejected left and right without proper reason. He argues that Some of the officials are involved in illegal practices. He moved on by requesting to do an inquiry on half-trained officials who are doing the harassment of users who file for name applications, through reasons which are not as per rules.
The pain of the other candidate is at its height when he mentions that the status of the ‘ticket’ raised by him surrounding the concern shows the ‘resolved’ status, without giving any solution to the problem in reality.
Another irritated professional asserts that if the period of 15 days is over, one has to refill all the data, which will waste the time of professionals, and asking the authorities to allow the notion of offline form filling.
The worst of all is that the users are asked to pay the accruing fee per day if they are not filling out the form, which is actually that they are not able to fill the form because of technical glitches! Even after the circular was sent, the MCA21 site did not waive fines. Corporations are receiving challans with extra costs as a result of a technical error on the website. A company’s highest penalty is currently 12X the normal fee, which fluctuates between INR 300 and INR 600; this is disgusting.
Why the government is not doing immediate action to resolve this issue which is faced by industry professionals all across the nation? Or if they are not able to find the solution from one vendor, then why they are not giving the contract to any other competitive vendor? Why there is this harassment of business professionals who are working day and night and contributing to the economic growth of the nation?
Several experts feel that these issues will take some time to address and that MCA should revert to V2 forms until they are. Additionally, the ministry should pilot test an upgraded version in a beta version before releasing it to the public the next time.
And if you are thinking that this is just a first case, hold on. There are earlier pictures where these technical glitches, after repeated complaints for several days, didn’t garner the attention of the government, and the company professionals feel harassed by such an unapologetic behavior of the government website.
The case before COVID.
The earlier case showed that the MCA21 portal has been in ‘error’ status since December 30, 2020, the day before the deadline to submit obligatory reports. According to reports, the appeal of lakhs of CSs, CAs, corporates, and professionals for an extension of the deadline until March 31, 2021, had failed to receive an answer from finance minister Nirmala Sitharaman or the Union government.
Yet it appears that MCA’s arrogance knows no limitations. While firms have faced punitive fines, the government has consistently rejected professional appeals as well as a social media storm.
Paying undue penalties is a headache for all, yet at least big companies could bear that loss. But what about the small ones? Why should small enterprises and professionals bear the failure of the MCA website on the due date, or pay for the unprofessionalism attitude of the government towards lakhs of pleas by the common man?
The last call for help.
It seems that the government is becoming habitual in taking the pleas of the general public on a light note; whether it is about the inefficiency of the MCA website or the ignorance of regulatory bodies in investigating Adani companies in such great losses! In either case, it is the general public or their hard-earned money which is going under the sword! When will the government would wake up from its sleep of arrogance, or has the torture of the common man just yet started and there are many more ‘Acche Din’ to come!!
